1. Agreement to Terms
These Terms of Service ("Terms") are entered into between you and AniTrackers LLC, an Oklahoma limited liability company ("AniTrackers," "we," "our," or "us").
By accessing or using the AniTrackers website, Ranch Console platform, hardware products, or related services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, you may not use the Services.
2. Description of Services
AniTrackers provides:
- GPS livestock tracking hardware
- A web-based herd management platform ("Ranch Console")
- Data storage and reporting tools
AniTrackers provides tracking and data management tools only.
We do not provide veterinary, agricultural, medical, or professional advice.
You remain solely responsible for herd management decisions and animal health outcomes.
3. Account Registration
To access certain features, you must create an account.
You agree to:
- Provide accurate and current information
- Maintain password confidentiality
- Accept responsibility for activity under your account
We may suspend or terminate accounts for violations of these Terms.
4. Hardware Purchases
All prices are in USD and subject to change.
Payment processing is handled by third-party providers (e.g., Stripe).
Risk of Loss
Risk of loss transfers to you upon delivery to the carrier.
Warranty Disclaimer
Except as expressly provided in a separate written warranty, hardware products are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.
5. Returns & Refunds
- Products may be returned within 30 days of delivery if unused and in original packaging.
- Refunds are processed to the original payment method.
- Shipping timeframes are estimates and not guaranteed.
6. User Data & Herd Information
You retain ownership of herd records and data you upload.
By using the Services, you grant AniTrackers LLC a worldwide, non-exclusive, royalty-free license to process and store your data solely to:
- Provide Services
- Improve functionality
- Ensure security
You are responsible for maintaining backups of important data.
7. Acceptable Use
You agree not to:
- Reverse engineer hardware or software
- Use automated scraping tools
- Upload illegal or harmful content
- Interfere with platform security
8. Intellectual Property
All website content, software, logos, and branding are owned by AniTrackers LLC and protected by law.
You may not reproduce or distribute content without written consent.
9. Disclaimer of Warranties
The Services are provided "as is" and "as available."
We do not warrant that:
- Services will be uninterrupted or error-free
- GPS signals will be continuously available
- Data will always be accurate or complete
10. Limitation of Liability
To the fullest extent permitted by law:
- AniTrackers LLC shall not be liable for indirect, incidental, consequential, special, or punitive damages.
- AniTrackers LLC's total liability shall not exceed the amount paid by you to AniTrackers LLC in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless AniTrackers LLC and its officers, employees, and agents from claims arising from:
- Your misuse of the Services
- Your violation of these Terms
- Your breach of applicable laws
12. Force Majeure
AniTrackers LLC shall not be liable for delays or failure to perform caused by events beyond reasonable control, including natural disasters, supply chain disruption, carrier delays, or governmental actions.
13. Termination
We may suspend or terminate your account for violations of these Terms.
Upon termination, your access to Services ceases immediately.
14. Governing Law
These Terms are governed by the laws of the United States and the State of Oklahoma.
You agree to the exclusive jurisdiction of courts located in Oklahoma.
15. Changes to Terms
We may update these Terms at any time. Continued use after updates constitutes acceptance.
